CONCORD, N.H. – The following bills related to RSA 100-A were enacted by the New Hampshire Legislature during the 2014 session and signed into law by the Governor. RSA 100-A is the statute governing the New Hampshire Retirement System (NHRS, the retirement system).
HB 1398 (Chapter 26, Laws of 2014) amends RSA 100-A:12 to allow the retirement system to make a lump sum payment of $15,000 or less to the next of kin of a deceased member when no probate proceedings are pending.
HB 1617 (Chapter 30, Laws of 2014) amends RSA 100-A:14 and RSA 5-C to grant NHRS electronic access to a limited data set of death, marriage, and divorce information of members and beneficiaries held by the Division of Vital Records Administration for purposes of administering RSA 100-A.
HB 1130 (Chapter 45, Laws of 2014) amends RSA 100-A:7 to allow retirees who have worked fewer than 1,300 hours in a calendar year to exceed the 32-hour per week statutory limit on part-time employment “while providing assistance during an emergency.” The statute defines an emergency as any event declared by the Governor or while working under the direction of the director of the Division of Forests and Lands during woodland fire control.
HB 1152 (Chapter 48, Laws of 2014) repeals the optional benefit program available to eligible call, substitute, or volunteer firefighters through the retirement system (RSA 100-A:19), and provides for the refund of remaining funds after the completion of payments to the current beneficiaries.
HB 1494 (Chapter 183, Laws of 2014) clarifies the definitions of terms used in RSA 100-A; establishes a procedure for assessing the true actuarial cost of service credit purchases; clarifies the ability to earn service credit while on a salary continuance plan; adds a penalty for employers who fail to submit required monthly data in a timely manner; and repeals obsolete provisions.
In addition to the bills listed above, Senate Bill 339 (Chapter 142, Laws of 2014) authorizes the state Department of Administrative Services to determine the feasibility of contracting with a credit card issuer to establish a credit card affinity program in which the fees received by the state are dedicated to reducing the retirement system’s unfunded liability.
