Working after retirement 'Grandfathering' capability added to DRS

CONCORD, NH – Legislation that took effect January 1, 2019, changed the laws governing New Hampshire Retirement System (NHRS, the retirement system) retirees working in a part-time position for retirement system participating employers.

Included in the new law is a “grandfathering” provision that allows retirees who were working part-time for NHRS-participating employers on the effective date of the law to work a maximum of 1,664 hours per calendar year for as long as they remain with the employer in the position they held on the effective date.

To meet the definition of “employed on the effective date,” a retiree would have had to work at least one day for the employer in calendar year 2018 and remain employed by the employer on January 1, 2019.

In order for NHRS to effectively administer this provision, employers are required by law to provide the names and position titles of retirees in their employment to NHRS no later than February 15, 2019. The names and position titles provided in 2019 will be used annually to verify that these retirees remain in the same position as of January 1 each calendar year, beginning in 2020.

NHRS has created an online format for employers to identify grandfathered retirees and enter position titles through the retiree reporting module of the NHRS Data Reporting System (DRS). The grandfathering capability is now live.

How it works

The grandfathering page will include the names of retirees that the employer reported hours worked for between January and November 2018. If a retiree recently began part-time employment and is not listed, please contact NHRS at (603) 410-3508 or email [email protected]. The retirement system will provide a copy of a formatted Excel spreadsheet. Fill in the required fields for each retiree you are adding and securely email the completed file back to NHRS. This information will be imported into the DRS by the retirement system.

Confirming retiree status: To confirm whether or not an employees is an NHRS retiree, employers can use the “Lookup NHRS Retiree” feature in the DRS retiree reporting module. Instruction are available here:

Note: The new law has eliminated the monthly retiree reporting requirement (HB 342). The first annual reporting of hours worked will be due in 2020. NHRS will develop a format for the annual reporting and will provide employer training prior to the start of the annual reporting requirement.
