Legislative change impacts Group II Accidental Disability annuitants

CONCORD, N.H. – House Bill 124 (HB 124), which was signed into law on July 9, 2013, affects New Hampshire Retirement System (NHRS) gainful occupation earnings limits for some Group II (Police and Fire) accidental disability annuitants.

HB 124 (Chapter 196, Laws of 2013) amended RSA 100-A:6 to exempt from annual gainful occupation limits those Group II accidental disability annuitants whose total of years of service as a member in Group II plus years of accidental disability retirement is at least 20 years, and who have attained the age of 45.

HB 124 applies to qualifying Group II disability annuitants for any tax year beginning after December 31, 2011.  For example, any Group II accidental disability annuitants who met the eligibility criteria as of December 31, 2012, are exempt from the current NHRS gainful occupation review of 2012 taxable income.

HB 124 does not affect those annuitants who are receiving a reduced disability pension in calendar year 2013 as a result of excessive 2011 earnings.

Group I (Employee and Teacher) ordinary and accidental disability annuitants and Group II ordinary disability annuitants continue to be subject to gainful occupation earnings limits until age 70.
